REVIEW OF SERVICE PLAN CITY OF DERBY ANNEXATION RESOLUTION 30-2015.

Body
The City of Derby is proposing to annex the Huckleberry Addition to Sedgwick County which adjoins the city limits. The City has provided the County a copy of the resolution setting the hearing date, and a copy of the service plan prepared for the annexation.
Under County Resolution No. 190-12, upon notice of a proposed unilateral annexation by a city, and receipt of the plan for extension of municipal services, the plan is distributed to the commissioners and various county departments for review and comment. Following receipt of comments, a report is to be presented to the Board at their next available meeting. A copy of the service plan has also been sent to the township where the properties proposed for annexation are located (Riverside).
The purpose of the review by the Board is to ensure that, when the Board holds the required postannexation hearing three years after the effective date of the annexation, the Board can determine whether or not the city has provided services in accordance with the plan.

Financial Considerations: None
Legal Considerations: The City is required to prepare a service plan, and send the plan to the County Commission, under the annexation act. K.S.A. 12-519, et seq. Under County Resolution No. 190- 12, a report on the service plan must be provided to the County Commission.
