Title

VAC2015-00023 - Request to vacate a plat located on the northwest corner of 63rd Street South and Clifton Avenue (County District 5).

Recommended Action:  Follow the recommendation of the Metropolitan Area Planning Commission, approve the Vacation Order and authorize the necessary signatures.

The applicant is requesting the vacation of all of the undeveloped 9.5-acre Woodvale Addition plat, except for Lot 1, Block B & Lot 11, Block A; both of these lots have single-family residence located on them.  The current Woodvale Addition is a remnant of the original plat, which was recorded with the Register of Deeds August 15, 1953.  Approximately three-quarters of the south portion of the plat was vacated in 1996; D-1996-1, Film 1592, Page 256.  The proposed vacation will not impact Clifton Avenue and 63rd Street South.  There are no public utilities located in the plat.

Analysis:  The Metropolitan Area Planning Commission (MAPC) voted (13-0) to approve the vacation request.  No one spoke in opposition to this request at the MAPC's advertised public hearing or its Subdivision Committee meeting.  Because the site is located in the City of Derby's Subdivision jurisdiction, consideration and recommendation by the Derby Planning Commission and the Derby City Council is required.  Both the Derby Planning Commission at their July 21, 2015, meeting and the Derby City Council at their August 11, 2015, meeting unanimously approved the vacation request; see attached Resolution No.21-2015
