Recommended Action: Approve the Highway Use Agreement and authorize the Chairman to sign.

 

The Kansas Department of Transportation (KDOT) is finalizing right of way acquisition for the construction of the first phase of improvements to the interchange at US-54 and I-235.  Sedgwick County acquired right of way for flood control purposes in the 1950's that was used for construction of the Wichita-Valley Center Flood Control Project.  The existing  interchange is built around the floodway and some of the new construction will encroach on the flood control right of way.  This agreement will allow KDOT to construct and maintain portions of the interchange within the right of way that Sedgwick County acquired for flood control purposes.

 

Alternatives:  Take other action as deemed appropriate by the Board of County Commissioners.

 

Financial Considerations:  None

 

Legal Considerations:  The Board of authorized by K.S.A. 19-101 third to convey any real estate interests owned by the County.
