Agreement with the City of Maize and the City of Wichita for Improvement of 37th St. North between Maize Rd. and 119th St. West (District 4).

Recommended Action: Approve the agreement and authorize the Chairman to sign.
Portions of 37th St. North between Maize Rd. and 119th St. West fall under the jurisdiction of Maize, Wichita and Sedgwick County.  The west three quarters of a mile are unpaved and need to be improved to meet the current traffic demand.  The purpose of this agreement is to allow the three parties to share in the cost to improve the road with Super Seal and then to assign maintenance responsibility of the completed road to Maize and Wichita.
Under the agreement, costs would be shared as follows:
     1.  Maize and Wichita would split to cost of construction (by contract) of the Super Slurry base.
     2.  Sedgwick County would construct the double chip seal with in house forces.
     3.  Sedgwick County would pay for the cost of high density mineral bond and pavement markings (by contract).
     4.  Sedgwick County would be responsible for design and construction of the project.
Alternatives:  Decline to enter into the agreement.
Financial Considerations:  The cost for Maize and Wichita is estimated to be $75,000 each.  The cost for Sedgwick County is also estimated at $75,000 but includes a combination of contracted construction, county forces and equipment and in stock materials.  Funding for contract construction is already budgeted in R-175 (2015).
Legal Considerations:  The BoCC is authorized to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth; and to perform such duties as required by law concerning roads under K.S.A. 19-212 Ninth. Under K.S.A. 12-2908, the BoCC may enter into contracts with other cities or townships to perform any governmental service, activity or undertaking that each entity is authorized to perform.
