Recommended Action: Approve the amendment and authorize the Chairman to sign.
On April 15, 2015, the BOCC approved a real estate purchase contract and amended that contract on May 6, 2015. The contract provided for closing no later than 30 days after May 6, 2015, but the parties have now agreed to extend the time for closing to no later than 120 days after the execution of this second amendment of the contract to allow sufficient time to resolve exceptions to title which would render the land unusable for the County's intended purpose. There is no change in cost or any other condition of the original contract.
Alternatives: The BOCC could choose not to approve the amendment in which case another method for modifying the original contract would need to be considered.
Financial Considerations: No changes in the cost or funding from the original contract.
Legal Considerations: The County is authorized by K.S.A. 19-101 second to purchase and hold real and personal property for the use of the County.
