RECOMMENDED ACTION: Adopt the Resolution.

Within Article 2 of the Unified Building and Trade Code (UBTC), the International Residential Code, 2006 Edition, along with local amendments was adopted by the Board of County Commissioners of Sedgwick County and the City of Wichita City Council as the residential code within the jurisdiction of the MABCD. Subsequently, the publisher of the International Residential Code released its 2009 and 2012 editions of the code. MABCD staff and members of the MABCD's Board of Building Code Standards and Appeals (Building Board) reviewed the International Residential Code, 2012 Edition, and extensively discussed it during meetings of the Building Board. The Building Board then voted and unanimously approved the adoption of the International Residential Code, 2012 Edition, along with the changes to the UBTC that are included within the resolution that is before the Board of County Commissioners, subject to some changes indicated in the subsequent paragraph.

Since this item was first presented to the Board of County Commissioners, a new Section 32 has been added, which defines the term "hoop house" and excludes hoop houses from building code requirements. Also, Section 23, which pertains to carbon monoxide ("CO") detectors has been modified such that CO detectors will be required for new residences but will not be required for existing residences.

Alternatives: The Board of County Commissioners could vote to not approve the resolution.
