AMENDMENT TO FUNDING AGREEMENT BETWEEN SEDGWICK COUNTY, KANSAS AND SEDGWICK COUNTY ZOOLOGICAL SOCIETY, INC.

RECOMMENDED ACTION: Approve and authorize the Chairman to sign the amendment to the funding agreement to change the date that notice of termination is to be given pursuant to paragraph 9 of said agreement.

Background: The Board of County Commissioners of Sedgwick County, Kansas, entered into a "Funding Agreement" with the Sedgwick County Zoological Society, Inc. ("Society") on the 11th day of September, 2013, to provide certain levels of funding to Society for the years 2014, 2015, 2016, 2017, and 2018. Paragraph 9 of said agreement states that either party may terminate the agreement by giving written notice to the other party by June 1, of any year, which termination shall be effective the following January 1. This paragraph 9 is being deleted in its entirety and replaced by a new section stating that either parting may terminate this agreement by giving written notice to the other party by September 1, of any year, which termination shall be effective the following January 1.
