Recommended Action: Approve the amendment and authorize the Chairman to sign.
 
On April 15, 2015, the BOCC approved a real estate purchase contract that included a legal description referring to Lot 34 of the Comotara Industrial Park Fourth Addition as owned by, and being conveyed to Buyer by EGM, Inc. as Seller.  The legal description is in error and was intended to refer to Lot 35 of said addition, instead, since Seller does not have legal title to Lot 34 of said addition, and the Buyer did not intend to purchase Lot 34 but instead intended to purchase Lot 35, this amendment replaces the incorrect legal description with the correct one and changes the effective date of the contract to the date the amendment is fully executed.  There is no change in cost or any other condition of the original contract.
 
Alternatives:  The BOCC could choose not to approve the amendment in which case another method for modifying the original contract would need to be found.
 
Financial Considerations:  No change in the cost or funding from the original contract
 
Legal Considerations:  The County is authorized by K.S.A. 19-101 second to purchase and hold real and personal property for the use of the County.
 
Policy Considerations:  This purchase follows established policies and procedures
