Agreement with Newman University for Wichita Gladiator Dash.

Recommended Action: Approve the Agreement and Authorize the Chairman to sign.
Newman University has requested use of a portion of Sedgwick County Park for the purpose of sponsoring and hosting the Wichita Gladiator Dash event and related activities, subject to reasonable inspections and access by County personnel on June 6, 2015.
The use granted is limited to the portion of the Park shown highlighted on the map, Exhibit A attached to the agreement. The agreement grants Newman University, as necessary for this event, controlled access to North Shore Boulevard, a roadway controlled and maintained by the County. Newman University agrees to coordinate with the Sheriff's Office with regard to traffic control on Lake Shore Boulevard during the event.
Newman University agrees to coordinate with the Park Superintendent, or his designee, concerning any conditions they may have for the use of any property under his management and control.
Financial Considerations: Large Event Fee of $250 as well as Shelters #1 and #2 fees of $40 each; Shelter #4 fee of $60; and, Shelter #5 fee of $25.
Legal Considerations: K.S.A. 19-212 allows the Board of County Commissioners to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities.
Terms and conditions of the agreement are similar to prior agreements for this event. A certificate of insurance, approved by the Office of the County Counselor, is required and has been provided pursuant to Section 5 of the agreement.
