Use Agreement for the Heart of the Matter Walk Event to be held on the southwest corner of Pine and Water Streets.

Recommended Action: Approve the Use Agreement and authorize the Chairman to sign.

Sedgwick County owns and controls property at the southwest corner of Pine and Water streets. Sedgwick County was recently approached by sponsor TCV Publishing for use of this property for a community event, the Camellia Gooch Lee Heart of the Matter Walk and Lunch. This is a heart disease education and awareness event to be held on Saturday, April 25, 2015 from 1 to 4 p.m. It includes a walk, a bagged lunch served after the walk, educational material, presentations and awards. This event is not a timed race, simply a walk to encourage an active heart healthy lifestyle. Staging and set up are to occur in the County-owned property at the southwest corner of Pine and Water streets. The walk is along the 1.5 mile designated African-American Walking trail. The event organizer has provided the required certificate of insurance and made arrangements with the City of Wichita to obtain any needed permits.

Alternatives: Do not approve the use agreement.

Financial Considerations: Per the use agreement, the County will receive a total of $50 for the attendance fee.

Legal Considerations: K.S.A. 19-212 allows the board of county commissioners to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities. The premises to be used does not include the area leased to the African American Museum. A certificate of insurance, approved by the County Counselor's Office and Risk Management, was provided in accordance with Section 7 of the Agreement.
