POST-ANNEXATION HEARING CITY OF MAIZE ORD. NO. 813.

RECOMMENDED ACTION: Open the public hearing, hear testimony, close the public hearing and make the required statutory finding.

In March 2010, the City of Maize annexed 25 tracts of land upon publication of Ord. No. 813. In accordance with state statute, the City was required to prepare a service plan stating what municipal services would be provided to landowners in the areas annexed. The Board of County Commissioners is required to hold a public hearing five years after the effective date of the annexation to determine whether the City has provided services in accordance with the service plan. A copy of the notice of hearing has been mailed to the City and each landowner in the area annexed.
Alternatives: At the close of the public hearing, the Board, based on the testimony provided, can: 1) find the City has provided services in accordance with the service plan; 2) find the City has not provided the services; or 3) take any other action deemed appropriate.

Legal Considerations: The hearing and finding is required by K.S.A. 12-531.
