Body
A public hearing is required to adopt a new residential building code within the Wichita-Sedgwick County Unified Building and Trade Code (UBTC) to replace the existing residential code within the UBTC.  In this case, the 2012 International Residential Code published by the International Code Council, with various amendments, additions, and omissions, is what is proposed to be adopted.
Background:   K.S.A. 12-3303 allows a county to adopt a code by reference.  In order to do so, it must give notice thereof by publication once in the official county newspaper.  Such notice shall identify the code proposed to be adopted and that area of the county in which the same will be applied, and fix the time for the holding of a public hearing before the Board upon the same.
Alternatives: None - statute requires that a hearing be set and notice shall be provided to the public.
Financial Considerations:  N/A
Legal Considerations:  Notice of Public Hearing is required to be published once in the official county newspaper by K.S.A. 12-3303.  The occurrence of a public hearing is a requirement for the adoption of the 2012 International Residential Code.
