Title
Resolution attaching Woodlawn Heights Addition, Eastborough, KS to Minneha Township.

Body
Recommended Action: Approve the Resolution.

The Woodlawn Heights Addition was platted in 1923, and is part of the City of Eastborough, which was incorporated as a city of the third class in 1937. Cities of third class are considered part of the township taxing unit for the township the city is located in. The part of Eastborough east of Woodlawn has always been considered part of Minneha Township. Woodlawn Heights Addition is west of Woodlawn and was originally part of Wichita Township. The Board disorganized Wichita Township in the early 1960s, and attached some parts of that township to other existing townships, but there is no record of the Board officially attaching Woodlawn Heights to Minneha Township. However, county records (election and tax) show that Woodlawn Heights was treated as part of Minneha Township for the last 40-50 years.

The City and Township requested the Board formally attach Woodlawn Heights Addition to Minneha Township. Notice of the request was sent to all landowners in the Woodlawn Heights Addition. At its regular meeting on February 18, 2015, the Board approved the request.

Considerations: None. The resolution reflects action already taken.

Legal Considerations: K.S.A. 19-212 Seventh authorizes the Board to change the boundary of any township at any meeting. Following approval by the Board of the attachment, the County Clerk is required by K.S.A. 19-230 to prepare a plat of the new township boundaries; to keep a copy of the plat under seal of the Board, and to send a copy to the township. The election commissioner will also prepare precinct maps reflecting the change in township boundaries.

Policy Considerations: None
