A Resolution amending the Exhibit to Resolution 189-2013 providing for the applicability of the Kansas Personal and Family Protection Act to County-owned and County-leased property.

Recommended Action: Approve the Resolution.
 
The exhibit to Res. No. 189-2013 lists various categories of county buildings and the status of concealed carry in those buildings, including buildings leased to a private (profit or non-profit) entity. These buildings are: Lake Afton Observatory; Zoo; Exploration Place; African American Museum; NCAT and the INTRUST Bank Arena. If these buildings are removed from the resolution it will have no immediate effect on whether the buildings are posted or not; since they are leased to private entities, those independent entities have either posted or not posted those buildings. Under the Personal and Family Protection Act, these buildings are not considered "municipal buildings" and therefore can continue to be posted against concealed carry. This resolution would amend the exhibit by removing the six buildings listed on the last page of the exhibit.
Alternatives: Not approve the resolution
Financial Considerations: There are no financial impacts to the County.
Legal Considerations: Local regulation of concealed carry must comply with the Personal and Family Protection Act, K.S.A. 75-7c01, et seq. Under K.S.A. 75-7c20, buildings leased to a private entity are not considered municipal buildings for the purpose of the act. The BoCC has the general power to make orders regarding real estate owned by the County under K.S.A. 19-101.
