SET POST-ANNEXATION HEARING DATE FOR CITY OF DERBY ORD. NO. 2006.

Body
The City of Derby annexed land in 2010, effective upon publication of Ord. No. 2006 on January 20, 2010. The City was required to prepare a service extension plan regarding the proposed extension of municipal services to the area to be annexed. The Board is required to hold a public hearing five years after the effective date of the annexation to determine whether or not the City has provided services in accordance with the service plan. Following approval of the notice of hearing, the notice will be sent to all landowners in the area, and to the City, by first class mail, postage prepaid.
The Board has adopted a process that includes sending out a prehearing questionnaire to the landowners regarding whether or not the City has provided services in accordance with the service plan. Two responses were received out of approximately thirty questionnaires sent. Those responses are included as part of the backup.

B) Set a different date for the hearing

Legal Considerations: The hearing is required by K.S.A. 12-531. The Board's process for conducting the hearing, including sending out prehearing questionnaires, is governed by Sedgwick County Res. No. 109-2012.
