EMS Post 9 Cross Lot Drainage Agreement.

This cross lot drainage agreement is required to satisfy a condition in the lot split requested through the Wichita-Sedgwick County Metropolitan Planning Department for the construction of EMS Post 9.
Recommended Action: Approve the agreement and authorize the Chairman to sign.
 
In July 2012 the BOCC authorized the purchase of land at 1218 S Webb Rd (Lincoln and Webb) for the construction of EMS Post 9, along with a Joint Access agreement with adjacent landowners for the purpose of establishing appropriate maintenance of an access road to the EMS Post.  Since the time of the land purchase, design has been completed on the EMS Post and a construction bid has been awarded.  During the design process it was discovered that drainage from the EMS site would need to be sloped to the west, across adjacent property, to be consistent with the development drainage plan and the Storm Water Pollution Prevention Plan.
 
Alternatives: The BOCC could choose not to approve the agreement, in which case another method for providing drainage to the site would need to be found.
 
Financial Considerations: None
 
Legal Considerations: Under KSA 19-101 fourth the Board is authorized to make all contracts and do all other acts in relation to county property necessary for the exercise of its corporate and administrative powers.
 
Policy Considerations: This agreement follows established policies and procedures.
