Recommended Action: Approve the use agreement and authorize the Chairman to sign.
Sedgwick County owns and controls property at 250 N. St. Francis, Wichita, KS ("Coleman Parking Lot").  Sedgwick County was approached by HopeNet and GoRace Event Management and Timing for use of the Coleman Parking Lot to host a fundraising event for HopeNet to be held on Friday, April 25, 2014.  The second annual event will include a run/walk race along the river originating and completing at the Coleman Parking Lot with a post-event including music, food and creating artwork .  This event will require closing of the parking lot for set-up, breakdown, and duration of the event and will require street closures of 2nd Street from St. Francis to Waco and St. Francis from 1st and 3rd Street.  GoRace Event Management and Timing has provided the required certificate of insurance approved by the County Counselor's Office.  
 
Alternatives: Do not approve the use agreement.
Financial Considerations: Per the use agreement, the County will receive a total of $175; $150 for the usage fee and $25 for the attendance fee.
Legal Considerations:
K.S.A. 19-212 allows the board of county commissioners to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities.  The Kansas Department of Health & Environment approves of this type of occasional use of the land.  The Use Agreement requires the user to comply with the Environmental Use Control Agreement (exhibit B to the Use Agreement).  A certificate of insurance, approved by the County Counselor's Office, was provided in accordance with Section 8 of the Agreement.
