RECOMMENDED ACTION: Find that the proposed permit application is consistent with the Sedgwick County Solid Waste Management Plan and ask Chairman to sign the KDHE Solid Waste Processing Facility Certification.

KDHE requires that the BOCC find that the State Solid Waste Permit Applications are consistent with local Solid Waste Plans. KDHE has recently reviewed the processing operations at Custom Wastewater Technologies of Wichita, LLC and determined that the facility is required to obtain a Solid Waste Processing Facility Permit. Custom Wastewater Technologies of Wichita, LLC, located at 3458 S. Hoover Road in Wichita, Kansas, has been working with KDHE on completing the permit application and the final step requires the BOCC to agree that the application is consistent with the Sedgwick County Solid Waste Management Plan. The Sedgwick County Solid Waste Management Committee reviewed this application at its meeting on April 7, 2014 to determine if this facility is consistent with the Sedgwick County Solid Waste Management Plan.

Financial Considerations: No financial impact is anticipated from the recommended action.

Legal Considerations: K.S.A. 65-3405 authorizes the county commission to adopt solid waste management plans. K.S.A. 2013 Supp. 65-3407(m) requires that before the Kansas Department of Health and Environment can review an application for a solid waste processing facility permit, the permit application must include a certification by the board of the county commissioners that the proposed facility is consistent with the Sedgwick County Solid Waste Management Plan.

Policy Considerations: The Sedgwick County Solid Waste Management Plan includes management of special wastes.
