Legal Considerations: The BoCC is authorized to purchase and hold real property for use of the county under K.S.A. 19-101 second; and to make all contracts in relation to the property and concerns of the county under K.S.A. 19-101 fourth. This easement is similar in terms and conditions to prior drainage easements approved by the BoCC for this purpose.
