Title
A resolution adopting a revision to the Sedgwick County Health Care Reimbursement Plan.  The revision will place a $2,500 cap on the Flexible Spending Account for all ensuring plan years effective January 1, 2013.

Recommended Action: Approve the resolution.
 
The Board of County Commissioners adopted Resolution No. 194-01 on December 19, 2001 creating Health Care Reimbursement Plan (as well as Flexible Benefit and Dependent Care Reimbursement Plans) for Sedgwick County and amended same in 2002, 2005 and 2006.  Currently, the Sedgwick County Health Care Plan permits eligible County employees to pay medical care expenses up to $5,000 with pre-tax dollars. The Health Care and Education Reconciliation Act of 2010 mandated that effective January 1, 2013 a $2,500 cap be placed on Flexible Spending Accounts (FSA) for all ensuing plan years.  
 
Analysis:    The enactment of this Federal law requires that the Sedgwick County Health Care Reimbursement Plan be amended to conform to the Act.  The Sedgwick County's Counselor's Department has prepared a Resolution that will bring the Sedgwick County Legal Plan Documents into conformance with the Federal Act.
 
Financial Considerations:  There is no cost to Sedgwick County for this amendment to its Flexible Spending Account Plan.
 
Legal Considerations:  The authority for this action is K.S.A. 19-101, et seq.  A simple majority vote is required.
 
Policy Considerations:  There are no policy implications affected by approving this Resolution.
