Recommended Action: Approve the Amendment and authorize the Chairman to sign.
Background: The language in Section 7 of the Contract for Fire Protection between the Fire District and Cessna Aircraft Company (the "Contract") does not contain the language "or been terminated" which is included in a similar agreement between the Fire District and Hawker Beechcraft Corporation. Pursuant to Section 9 of the Contract, Cessna Aircraft Company has the right to request that the Fire District consider a modification to conform Section 7 of the Contract to include the "or been terminated" language.

Legal Considerations: The proposed Second Amendment to Contract for Fire Protection was prepared by Gilmore & Bell, P.C., Special Counsel to the Fire District. It has been reviewed and approved as to form by the County Counselor's Office.
