Recommended Action: Approve the resolution
The Sedgwick County Zoological Society, Inc ("Zoo") currently holds a cereal malt beverage license issued by Sedgwick County Board of Commissioners which expires December 31, 2011. The Zoo is requesting and does hereby consent to and support the voluntary suspension of its license for one (1) day, specifically Friday, September 30, 2011 to facilitate the "Cocktails with Creatures" event at the Sedgwick County Zoo that day. Because of a change in law in 2010, the Kansas Department of Revenue no longer requires the Zoo to obtain a temporary permit. However, a suspension of the cereal malt beverage license remains necessary in order to comply with state law.

Legal Considerations: K.S.A. 2010 Supp. 41-2704(g) and K.S.A. 2010 Supp. 41-2708(a)(5) prohibit alcoholic liquor from being on premises licensed for cereal malt beverage sales. K.S.A. 2010 Supp. 41-2703 places responsibility for licensing the retail sale of cereal malt beverage upon counties. In order to comply with statutes, limited suspension of the cereal malt beverage license is necessary and the county has the power to do so under K.S.A. 2010 Supp. 41-2703. A majority vote is required.
