Title

First amendment to the lease agreement between Keith Bomholt and Sedgwick County for apartments located at 725-755 Hunter and 6511-6517 Cottonwood for COMCARE's Transitional Housing Program.

Recommended Action: Approve the agreement.

 

Background: In August 2003, COMCARE's Homeless Program received HUD's approval to implement a Transitional Housing Program. The program has continued to run successfully since its inception. COMCARE's Transitional Housing Program (THP) offers stable housing, mental health services, addiction treatment, and banking services for people enrolled at any point in time for a duration of up to two years. The leased space provides for one apartment to be used for THP office space and 16 apartments for THP participants.

 

This First Amendment to Lease Agreement is for a one-year term through July 2013, with language added to allow the agreement to renew automatically each successive year.  Automatic renewals are subject to the program continuing to receive annual approval from the Department of Housing and Urban Development (HUD) for the grant that is used to pay lease costs for these units.  It should be noted that the original lease agreement also contains language allowing for termination with a 30 day notice.

 

Alternatives: The BoCC could choose not to approve this First Amendment to Lease Agreement, in which case COMCARE would need to immediately find alternative housing for all THP participants currently living in the apartments.

 

Financial Considerations: 310635-13 Center City HUD Grant (08/01/2012 - 07/31/2013)

 

Monthly costs:

14, one-bedroom apartments x $452.41 = $6,333.74

2, two-bedroom apartments x $605.21 = $1,210.42

1, THP office x $605.21 = $605.21

 

Annually not to exceed $97,792.44

 

Legal Considerations:  The authority for this action is K.S.A. 19-101.  A simple majority vote is required.

 

Policy Considerations: All Sedgwick County policies have been followed.
