Recommended Action: Approve position reclassification.
This request is asking for a reclassification of an existing part-time position to a full-time position as soon as possible. The current position is part-time, no benefits and the reclassification would result in a full time benefited position.
This has become necessary due to the labor intensive unfunded state efiling mandate. The Kansas Supreme Court mandated that all documents filed by or on behalf of a licensed attorney in traffic court be efiled effective October 3, 2016, and all criminal and juvenile cases effective January 4, 2017. After analyzing the processes and modifications necessary, the determination has been made that it is impossible to absorb the increased responsibilities with existing staff. Every document filed generates email notifications that are required to be monitored to determine if action is needed or a response necessary and ensure it gets to the proper attorney and/or staff person in the office to fulfill statutory duties. Over the last few months, the process of modifying documents and processes to comply with this mandate has been implement in stages. Thus far, over 15,000 notifications have been received for traffic and criminal cases resulting from filings submitted through the efiling system. The Kansas Supreme Court has also required that all notifications must be maintained while the case is pending. It is necessary to conform to the processes required by efiling, resulting in an extreme strain on existing staff and available resources.
Alternatives: Forego the reclassification, leaving the office without additional resources, and unable to meet all of the statutory and mandated duties imposed.
