Recommended Action: Approve the easement and authorize the Chairman to sign
 
KPTS has acquired a parcel of land east of Seneca, between 61st St. North and 69th St. North. The parcel is landlocked, but adjacent to property owned by the County which is part of the flood control project. The County has a driveway that runs along the west side of the flood control project that KPTS has requested the permission to use for access to their antenna site. KPTS has agreed to provide a contingent dedication/easement of up to 30 feet width along the easterly side of their property for use by the County if needed for flood control project improvements.
 
Alternatives:      A)      Approve the easement and authorize the Chairman to sign
            B)      Do not approve the easement
            C)      Take other action deemed appropriate
 
Financial Considerations: None. Use of the easement by KPTS will not require any expenditure of County funds.
 
Legal Considerations: The Board is authorized by K.S.A. 19-101 third to convey any real estate interests owned by the County.
 
Policy Considerations: The proposed use of the easement by KPTS will not affect current or future flood control project operations; and will allow KPTS to site and operate an antenna to improve their signal coverage.
