Title

PUD2009-00006 - Extension of time to complete platting requirement for a zone change from RR Rural Residential (“RR”) zoning to create PUD #33, The Polo Complex Planned Unit Development, generally located on the northeast corner of 95th Street South and Broadway Avenue.  (BoCC #2).

Body

Recommended Action: Approve the extension request.

On February 3, 2010, the Board of County Commissioners approved a zone change from RR Rural Residential (“RR”) to PUD Planned Unit Development (“PUD”) subject to the condition of platting within one year.  The subject site is located within the City of Haysville’s extraterritorial subdivision jurisdiction.  A sketch plat has been discussed with the City of Haysville’s Planning Commission Subdivision Committee, but final plat approval has not been obtained.  The applicant is requesting a six-month platting extension through the County.

Analysis:  Staff recommends that a six-month extension of time to complete platting requirements be granted to extend the platting deadline to July 25, 2012.

Alternatives:  The Board of County Commissioners may deny the request for an extension of time to complete platting.  Such a decision would declare the zone change null and void and would require reapplication and rehearing if the property owner still desired the zone change.

Financial Considerations: None

Legal Considerations: Platting extensions are authorized by MAPC Policy Statement #5.
