Waiver, Consent and Release of Liability Agreements for Placement of Dumpsters for Storm Debris.

Recommended Action:  Approve the agreements and authorize the Chairman to sign.

 

Background:   Sedgwick County has made available at no cost to property owners a number of trash receptacles for the cleanup of storm debris.  Sedgwick County also is providing free removal and disposal of the debris for property owners and their tenants.  Several property owners have elected to accept the dumpsters and have signed the attached waivers, releasing Sedgwick County from any liability related to the placement, storage, transfer or removal of the dumpsters.

 

Financial Considerations:  The County will pay nothing to the property owners for this temporary use of their land, and these waivers will release the County from any damage claim that might be made by the property owners.

 

The County will pay for the cost of the dumpsters and associated disposal services.  If this storm event is determined to be eligible for partial FEMA funding of public costs, the County's costs will be reimbursable.  The costs to the County are: $25.00 to place a dumpster, $85.00 to haul it to a transfer station (plus a 15% fuel and material surcharge), and $57.00 per ton for waste left at the transfer station.  The final cost of dumpsters and associated disposal costs cannot be estimated at this time.  These costs are being charged to 70010-110, FEMA Disaster fund center.  Total budget authority of $20,000.00 has been established for this fund.

 

Legal Considerations:  These agreements relieve Sedgwick County of liability associated with the placement, storage, transfer or removal of the dumpsters.  The authority for this action is K.S.A. 19-101.  A simple majority vote is required.
