Recommended Action: Establish 2018 Budget Authority Asset Forfeiture Fund, 18014-259.
The Prosecuting Attorney Trust Fund is established by law under the Kansas Asset Seizure and Forfeiture Act, Chapter 60, Article 41, et seq. A part of this act expressly provides law enforcement and prosecutors with a portion of the funds derived as a result of property seized and forfeited via this act and may be used for legitimate law enforcement and prosecutorial purposes, including training, equipment and educational purposes.
Statutorily it is not allowable to anticipate future revenue and therefore budget authority was not established for this fund (18014-259) during the normal 2017 budget processes. The District Attorney's Office is requesting budget authority to meet current and pending expenditure needs anticipated throughout the remainder of the year.
