Recommended Action: Follow the recommendation of the Metropolitan Area Planning Commission, approve the Vacation Order, and authorize the necessary signatures.

Background: The applicants propose to shift the platted permitted access onto 183rd Street West from the south 15 feet of the west lot line of their property (Lot 10, Block A, Eck 6th Addition) to a point beginning 175 feet north of the south property line. The applicants currently have a platted shared access with their abutting southern neighbor; 15 feet on each side of the common lot lines of Lots 10 & 11, Block A, Eck 6th Addition. The proposed access/drive would line up with the applicant's garage. The proposed drive will be separated from the abutting southern property's recently constructed accessory structure, located just south off of the platted shared access/drives. The applicants propose to discontinue the use of the platted shared access. There are no utilities located in the area of the vacation request. The Eck 6th Addition was recorded with the Register of Deeds November 1, 2000.

Analysis: The MAPC voted (9-0) to approve the vacation request. No one spoke in opposition to this request at the MAPC's advertised public hearing or its Subdivision Committee meeting. The City of Goddard's Planning Commission approved this request at their March 14, 2013, meeting. No one spoke in opposition to this request at the Goddard meeting. No written protests have been filed.
