Lease with Triple J of Wichita for old Fire Station 36.

Recommended Action: Approve the no cost lease and authorize the Chairman to sign lease and waiver.
In February 2012, the BOCC approved the sale of the existing Fire Station 36 at 6400 S Rock Rd to Triple J of Wichita for land and other considerations in order to construct the new Fire Station 36 at 5055 S Oliver Rd. The title transfer of 6400 S Rock Rd was conditional on the completion of construction and transfer of operations to the new station, expected to happen in August 2013. Triple J has since asked the title be transferred ahead of that date so they may enter into easement negotiations with utility providers, which must be done by the land owners, and continue the planning for their development. This no cost lease will keep the Fire District operating from their current location until the new station is complete and operations have transferred, just as the original agreement was written. The title transfer will also put the property back on the tax roll immediately instead of August, which will be the responsibility of Triple J. This request will also require the signing of a waiver of the requirement of transfer of operations from the original contract.
Alternatives: BOCC could choose not to approve this lease in which case the title would be transferred after completion of the new station.
