Title
A RESOLUTION EXEMPTING THE PARKING LOT LOCATED AT 250 N. ST. FRANCIS, WICHITA, KANSAS FROM THE PROHIBITION IN K.S.A. 47-719 (C) AGAINST CONSUMPTION OF ALCOHOLIC BEVERAGES ON PUBLIC PROPERTY.
Presented by: Tania Cole, Project Services Program Manager.

Recommended Action: Adopt the resolution.

Body
Background: Sedgwick County owns the parking lot located at 250 N. St. Francis, Wichita, KS and has received requests from community groups to use the parking lot for community events.  Some community events and groups may want to have the ability to serve and consume alcoholic liquor during their event on the premises.  This resolution would allow these groups to serve and consume alcohol liquor upon entering into a written agreement with Sedgwick County.  Event holders would still be required to obtain applicable permits for sale and consumption of alcoholic liquor in compliance with all applicable City and State regulations.

Alternatives: Deny the resolution.
Financial Considerations: N/A
Legal Considerations:  K.S.A. 2011 Supp. 41-719 prohibits drinking and consuming alcoholic liquor on public property but grants local governments (including the Board of County Commissioners) the authority to exempt land owned by the local government from application of the statute.
