REVIEW OF ANNEXATION SERVICE PLAN PREPARED FOR CITY OF DERBY RESOLUTION NO. 1-2014.

Body
The City of Derby proposes to annex six tracts of land ranging in size from .70 acres to 4.89 acres. Four are single family residential, one is commercial and one is vacant. The City has prepared a service plan as required by statute. The City will hold a public hearing on April 8, 2014, regarding the proposed annexation.

County staff, under the Board's Resolution No. 190-12, upon receipt of the service plan, review the plan for compliance with the statutory requirements, conformance to the comprehensive plans, and also to determine if there are any overlap of municipal services if the annexation is finalized. In addition, staff reviews whether the proposed annexation includes annexation of any adjoining public right of way. After review by staff, the attached report is prepared and presented to the Board at the next available meeting for its review and comment.

Staff's review concludes the service plan substantially complies with the statutory requirements.

B. Direct the County Counselor to notify the City of any comments made by the Board
C. Direct the County Counselor to prepare a resolution stating any findings made by the Board
D. Direct a county representative attend and testify at the City's public hearing on the annexation
E. Any other action deemed appropriate

Financial Considerations: None

Legal Considerations: The City is authorized to annex these properties under K.S.A. 12-520, but must substantially comply with the requirements of the annexation act, K.S.A. 12-519, et seq. The Board is required to hold a public hearing three years after the effective date of the annexation (or after the termination of any litigation regarding the annexation).
