RESOLUTION STATING FINDINGS MADE AFTER POST-ANNEXATION HEARING HELD ON OCTOBER 26, 2011 REGARDING VALLEY CENTER ANNEXATION ORDINANCE NO. 1126-06.

RECOMMENDED ACTION: Approve the resolution and authorize the Chairman to sign.

On October 26, 2011, the Board held the hearing required by K.S.A. 12-531, and after the close of the hearing, made a unanimous finding that the City of Valley Center had provided the services set out in the service plan prepared for the land annexed by Valley Center Ord. No. 1126-06. It was subsequently determined that two property owners had not been notiifed of the hearing date. These property owners have been notified of this error and have been offered the oppotunity to present testimony to the Board on this matter. One landowner has waived the lack of notice and does not intent to offer any testimony. The City and other landowners were also notified of the lack of notice to the two landowners.
Alternatives:
A. If no landowners appear to testify on this matter, then approve the resolution and authorize the chairman to sign.
B. If any landowner appears to testify, then the Board may re-open the hearing, receive testimony, and following the close of the hearing should make the appropriate finding.
C. Take any other action deemed appropriate by the Board.

Outside Attendees: Representatives of the City of Valley Center, and landowners in the area annexed.
