Resolution Rescinding Resolution 47-2002 and Authorizing the Division of Human Services Department Directors and the Division of Public Safety Director to Enter into Certain Contracts and Agreements.

Recommended Action: Approve the Resolution and allow the Commissioners to sign.
Background: The Department on Aging, Community Developmental Disability Organization (CDDO), COMCARE, Health Department, and Emergency Medical Services (EMS) Department all provide health care services through agreements with contracting payors and managed care organizations (MCO's) that outline service rates and expectations in a consistent and predictable manner. Rather than use County resources placing each contract on the Board of County Commissioners (BOCC) agenda to approve substantially the same content, this resolution authorizes the Department Directors in the Division of Human Services and the Director of the Division of Public Safety to review and enter into these agreements on behalf of the BOCC with the written approval of the County Counselor's Office. Directors will notify the County Commission when they have signed such a contract and copies will be distributed to the Finance Department, County Clerk, and County Manager's Office.
Alternatives: Without this Resolution, each agreement with the MCO's for all the above noted departments will have to be placed on the BOCC agenda for consideration, and may result in an irretrievable loss of income to the County.

Legal Considerations: The authority for this action is K.S.A. 19-101. A simple majority vote is required.
