Recommended Action: Staff recommends that a one-year extension be granted to extend the platting deadline to November 1, 2011.
Background: On August 8, 2007, the Board of County Commissioners approved a zone change from SF-20 Single-family Residential (“SF-20”) to LC Limited Commercial (“LC”) on 3.5 acres located south of K-96, along the west side of North Hoover. The zone change was approved subject to platting the property within one year. The applicant started the process of platting the site in 2007; however due to a highway study commissioned by the City of Wichita for K-96 and Hoover Road, the plat was put on hold for a period of time. The plat was recorded on May 13, 2011, but to fill in the time and to have the records in order from when the plat was started and recorded, the property owner was advised to file a retroactive platting extension. The property owner is requesting a platting extension for the time period from December 23, 2010 to November 1, 2011 (see the attached letter).
Analysis: Staff recommends that a one-year extension of time be granted to extend the platting deadline to November 1, 2011.
Alternatives: The Board of County Commissioners may deny the request for an extension of time to complete platting. Such a decision would declare the zone change null and void and would require reapplication and rehearing if the property owner still desired the zone change.
