Sedgwick County Fire District 1 (SCFD1) is in the process of negotiating a mutually beneficial land exchange to relocate Station 36 from its current site at 63rd St and south Rock Road to one in the vicinity of south Oliver and 47th Street. In executing the work pursuant to an agreement with the landowner, it was discovered that Sedgwick County and not SCFD1 is named as owner of the existing Station 36 in the public record. Some of the older properties acquired for fire stations were put in the countys name, but the preferred owner would be the fire district for ease of the proposed land exchange transaction. By transferring the title of the fire station to the fire district, we can have a simple two party transaction on the property swap, since the new property will be acquired in the name of the fire district.
Alternatives: The county can retain ownership as a party to the transaction. The real estate transaction with the landowner for the property needed for new Station 36 will then need to be a three party deal: the county (Party #1) transfers the title of the existing first station to the landowner (Party #2); landowner transfers title of the new fire station site to the fire district (Party #3).
Financial Considerations: The county will receive no compensation from the fire district for transferring ownership of Station 36.
Legal Considerations: This action will simplify a subsequent legal transaction for a proposed exchange of property.
