A RESOLUTION BANNING THE SALE, IGNITION, AND USE OF AERIAL LUMINARIES; TO BE EFFECTIVE WITHIN THE UNINCORPORATED AREAS OF SEDGWICK COUNTY, KANSAS, INCLUDING THOSE AREAS INCLUDED WITHIN SEDGWICK COUNTY FIRE DISTRICT NUMBER ONE, INCLUDING THOSE CITIES LOCATED THEREIN WHICH HAVE BY ACTION OF THEIR GOVERNING BODIES ADOPTED THE CONTENT OF THIS RESOLUTION INTO AN ORDINANCE AND WHICH HAVE ENTERED INTO A SEPARATE AGREEMENT WITH SEDGWICK COUNTY AND SEDGWICK COUNTY FIRE DISTRICT NUMBER ONE PROVIDING FOR ENFORCEMENT WITHIN THEIR MUNICIPAL BOUNDARIES BY OFFICERS OF THE FIRE PREVENTION DIVISION AND CONFERRING JURISDICTION UPON SEDGWICK COUNTY FOR ALL PROSECUTORIAL FUNCTIONS RELATING THERETO; AND AMENDING CHAPTER 12, ARTICLE II, OF THE SEDGWICK COUNTY CODE.

Financial Considerations: There is no financial impact.
Legal Considerations:
(1) K.S.A. 19-101 permits the Board of County Commissioners to utilize the powers of home rule to determine their local affairs and government.
(2) K.S.A. 19-101d grants the Board of County Commissioners authority to enforce all resolutions passed pursuant to the county home rule powers.
(3) Simple majority vote required to adopt the resolution.
