Approval of an agreement between The Board of County Commissioners and Newman University for use of a portion of Sedgwick County Park for the purpose of sponsoring and hosting the "Wichita Gladiator Dash" event.

Recommended Action: Approve the Agreement and authorize the Chairman to sign.
This agreement allows Newman University exclusive use of a portion of Sedgwick County Park for the purpose of sponsoring and holding the "Wichita Gladiator Dash" event and related activities on Saturday, June 8, 2013.  
 
This event will require controlled access to certain portions of County roadways, as such, by this agreement the County grants Newman University, as necessary for this event, controlled access to Lake Shore Drive, a roadway controlled and maintained by the County.  Newman University agrees to coordinate with the Sheriff's Office with regard to traffic control on Lake Shore Drive during this event.
Financial Considerations: Revenues into the General Fund include Large Event Fee of $250 as well as Shelter fee #1 $40, #4 $60, #5 $25, and Horseshoe Shelter fee of $90.
Legal Considerations: K.S.A. 19-212 allows the board of county commissioners to make such orders concerning county property as deemed expedient and to have care of county property.  K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property.  K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities.
K.S.A. 19-212 vests the Board of County Commissioners with broad powers in conducting the business of the county at a meeting.  The county's general police powers allow protection of the public health, safety, and general welfare of the public.  This is the second year for this event.  A certificate of insurance, approved by the County Counselor, is required to be provided prior to the event in accordance with Section 5 of the Agreement.
