Approval of a tolling agreement with the United States Army Corps of Engineers (USACE) for submittal with a permit application covering work on Dry Creek.  District 3.

Recommended Action: Approve and authorize the Chairman to sign.

 

The USACE has determined that debris clearing activity that has been previously performed or is currently proposed by Sedgwick County Public Works along Dry Creek near 21st St. N. and 135th St. W. requires a federal permit.  Public Works has agreed to submit the required permit application covering both an area that has already been completed and areas that are proposed for debris removal.  USACE requires the submittal of a tolling agreement as part of the permit application because it includes work that has already been completed.  The tolling agreement preserves the USACE’s ability to pursue legal action against Sedgwick County until one year after the USACE either issues or denies the requested permit.
