Recommended Action: Approve the notification and authorize the Chairman to sign the letter exercising one month of the month-to-month term and providing notice of lease termination effective March 6, 2012
Background: Sedgwick County COMCARE has occupied space at 154 N. Topeka since August 2004. COMCARE will be moving the homeless program to a new location in February, 2012. The new location is a co-location and community partnership with United Methodist Open Door (UMOD). The lease document provided COMCARE the option to terminate with a 180 day notice. In addition, the building owner agreed to a month-to-month option beginning January 6, 2012, should the option be necessary due to new building construction timeline. As a result, on July 27, 2011, the BoCC approved the lease termination effective February 6, 2012. The construction and move-in timeline will require that COMCARE enter into a month-to-month lease arrangement from February 6, 2012 through March 6, 2012 with final termination of the lease occurring March 6, 2012. Notification of our intent is required within 30 days, or January 6, 2012. And notification of our intent to terminate the lease is required within 30 days, or February 6, 2012
Alternatives: The BoCC could choose to not approve the month-to month notification, in which case COMCARE would have to fulfill the requirement of their termination and relocate prior to February 6th. This date would be difficult to meet due to current construction/move schedules. If the month-to-month is not approved, no further action would be required for termination.
Financial Considerations: The lease rate continues at the original contracted rate throughout the month-to-month option.
