Recommended Action: Adopt the Resolution

 

From time to time Community Groups need certain equipment for special events that is not readily available in the commercial marketplace. This resolution designates the Director of the Kansas Pavilions or his designee as contracting agent for entering into agreements for rental of certain specialized county equipment located at and used by the Kansas Pavilions. Said equipment includes, but is not limited to: bleachers, risers, dirt, stall panels, livestock fencing and gates.

Financial Considerations: None

 

Legal Considerations: K.S.A. 19-212 allows the BOCC to make such orders concerning county property as deemed expedient and to establish regulations, by resolution, as to the use of such property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. Equipment rental agreements are to be based on the standard form agreement (attached to the resolution as Exhibit A) using minimum rental rates based on fair market value which are established by the Director and presented to the Board of County Commissioners. A certificate of insurance covering the replacement cost of the equipment will be required to be provided by the lessees. A majority vote is required for approval. The resolution will be effective upon passage.

 

 

 

 

Resolution 29-1989 similarly delegated authority to the Director for entering into agreements for events.

 

Policy Considerations: This designation is in accordance with Resolution No. 29-1989 adopted by the County Commission on February 1, 1989 establishing rules, regulations and guidelines for entering into agreements for events at the Kansas Pavilions.
