Resolution Temporarily Suspending the Kansas Pavilions Cereal Malt Beverage License.

Recommended Action: Adopt the Resolution.
The Kansas Pavilions currently holds a cereal malt beverage license issued by the Sedgwick County Board of Commissioners which expires December 31, 2011. The Kansas Pavilions is requesting and does hereby consent to and support the voluntary suspension of its license for one (1) day, specifically Monday, September 26, 2011 to facilitate the "Kansas Beefeater's Steak Feed" event promoted by the Kansas Junior Livestock Show at the Pavilions that day. A suspension of the cereal malt beverage license is necessary in order to comply with state law.

Legal Considerations: K.S.A. 2010 Supp. 41-2704(g) and K.S.A. 2010 Supp. 41-2708(a)(5) prohibit alcoholic liquor from being on premises licensed for cereal malt beverage sales. K.S.A. 2010 Supp. 41-2703 places responsibility for licensing the retail sale of cereal malt beverages upon counties. In order to comply with statutes, limited suspension of the cereal malt beverage license is necessary and the county has the power to do so under K.S.A. 2010 Supp. 41-2703. A majority vote is required.
