Approval of an Agreement with the City of Derby and Rockford Township for Construction of Super Seal Road on 87th St. South between Rock Road and Webb Road. R-342. District 5.

Recommended Action: Approve the agreement and authorize the Chairman to sign.
87th St. South between Rock Road and Webb Road has been selected for replacement as part of the Cold Mix and Gravel Road Replacement Program (CIP R-342) for 2016. Part of the road is within or adjacent to the City of Derby and the remainder is on the Rockford Township Road System. Expected construction costs for this project are higher than normal due to some extraordinary drainage and grading requirements. The City of Derby and Rockford Township have agreed to participate in financing the project. If the bid price exceeds a project cap of $511,863.34, the City of Derby will be notified and given an opportunity to reconsider their maximum contribution to the project before the County awards the contract.
Alternatives: Do not approve the agreement.
Financial Considerations: The agreement is based on an estimated construction cost of $487,489.00 but provides for a 5% allowance for construction cost contingencies which will allow an additional expenditure of $24,374.45 without seeking consent from the City of Derby. County budgeting is based on a total of $511,863.45 and sufficient budget authority exists in R-342 for the total cost. The cost breakdown to the three units of government is as follows:
Sedgwick County $238,931.73 (Half of actual costs to be paid from R-342)
City of Derby $238,931.72 (Half of actual costs to be paid within 30 days after monthly billings)
Rockford Township $34,000.00 (Lump sum payment split over 2017 and 2018)
Total $511,863.45
