APPROVAL OF AGREEMENT WITH YOUNG HUNTERS SAFETY, INC (YHSI) TO OPERATE AND SUPERVISE THE LAKE AFTON PUBLIC SHOOTING RANGE.

RECOMMENDED ACTION: Approve the agreement and authorize the Chairman to sign.

 

Body

Background: This is the renewal of an existing agreement which allows Young Hunters Safety, Inc to be the exclusive operator and supervisor of the Lake Afton Public Shooting Range in accordance with the covenants, terms and conditions set forth in the Agreement. The term of this agreement shall be for a period of five years commencing on the 1st day of March, 2012. Thereafter, this agreement will automatically renew for a term of one year for four consecutive years unless either party gives the other party written intent to not renew prior to the expiration of the then current term.

 

Financial Considerations: None

 

Legal Considerations: K.S.A. 19-212 allows the BOCC to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq allows counties broad authority to operate recreational facilities and activities. A certificate of insurance, approved by the Office of the County Counselor is required pursuant to Section 3. B. of the agreement. The group has operated this range for many years. Terms and conditions in prior agreements were substantially similar; however, this agreement allows the Sheriff's Office to use the facility and contains a mutual indemnification clause.
