Recommended Action: Approve the lease and authorize the Chairman to sign the documents.
The digital 9-1-1 radio system hinges on the proper siting of the ten (10) radio towers. The specific location is necessary to complete the coverage network for optimal radio communications between 9-1-1 dispatchers and first responders in the field.
Alternatives: Deny the request. A denial will result in the halting of the digital radio system project.
Financial Considerations: $2,840 per month for years 1 - 5. The term is for five (5) years with four (4) additional terms of five (5) years each renewed automatically unless not renewed by either party. Funding to cover the costs of the lease will come from 9-1-1 tax revenues. Sufficient budget authority exists in the 2013 adopted budget to cover the full cost of the leases from cost center 11003-210.
Legal Considerations: The terms and provisions of tower leases have been negotiated between counsel and incorporate FCC Rules and Regulations, including priority and Public Safety Interference Regulation and Proceedings. Approval is by simple majority vote. The authority for this action is K.S.A. 19-101, et seq.
