Contract with the City of Wichita for acquisition of a drainage easement and a temporary construction easement for Sedgwick County Project D-20.

Recommended Action: Approve the contract and authorize the Chairman to sign.
 
Sedgwick County has been working with the City of Wichita since late 2011 to obtain these easements for a major drainage project located near 55th St. South and Clifton.  One half mile of the project (approximately one third of the total project length) must be constructed across a 105 acre parcel owned by the city.  Acquisition of these final easements will allow the project to move to letting and construction.
 
This contract is scheduled for action by the City of Wichita on June 4, 2013.  The City of Wichita generally enters into real estate contracts when transferring easements and provides the final documents at a closing after all parties have signed the real estate contract.  A closing will be scheduled after the Board of County Commissioners approves the contract and returns it to the City of Wichita.
 
Alternatives:  Delay or cancel the project.
 
Financial Considerations:  The City of Wichita is providing the two easements at no cost to Sedgwick County.  Excess soil from the project will be used to elevate low areas on the city owned property.  Sedgwick County will be responsible for maintenance and repair of the ditch and structures that are constructed within the easements for this project.
 
Legal Considerations: The County is authorized to obtain real property for the use of the County under K.S.A. 19-101 second.
