RESOLUTION NOTIFYING THE CITY OF ANDOVER TO ANNEX PART OF 159TH ST. E BETWEEN KELLOGG AND CENTRAL.

RECOMMENDED ACTION: Approve the resolution and authorize Chairman to sign.

The City of Wichita adjoins the west side of 159th St. E. between Kellogg and Central and the City of Andover city limits adjoin the east side of 159th St. E between Kellogg and Central. The County has been working since 2011 with both cities regarding the annexation of this section of 159th St. E. On July 13, 2012, the City of Wichita annexed the west half of 159th St. E, between Kellogg and Central. Andover has not annexed the east half of 159th between Kellogg and Central.
The annexation act provides that if the BoCC notifies a city of the existence of any highway which has not been annexed by the city, but that has a common boundary with the city, the city must then certify, by ordinance, that the notification by the BoCC is correct; and the city must then annex the highway. The notification by the BoCC must include the legal description of the highway, and a map identifying the location of the highway. The proposed resolution meets the statutory requirements for notice to the city under K.S.A. 12-520(f). Following receipt of the resolution the City of Andover will be required to certify the resolution is correct and then annex the east half of 159th St. E. between Kellogg and Central.

B) Do not approve the resolution and take no other action
C) Take any other action deemed appropriate
