Body
A petition requesting the creation of Greenwich Plaza Addition Storm Water Drainage improvement benefit district (the "District") and the construction of storm water drainage improvements therein (the "Improvements") has been filed with the County Clerk. The petition has been signed by the owners of 100% of the property within the proposed District, as determined by Sedgwick County Public Works. The lots will be assessed fractionally so that each lot will bear a proportionate share of the costs of the Improvements to the benefits derived therefrom for such lot. Greenwich Plaza is located on the southeast corner of Greewnich Road and 31st St. South.

Alternatives: Deny the petition. If the petition is denied, the property owners would be required to finance and construct the improvements privately.

Financial Considerations: The total estimated cost to complete the project in November of 2010 was $35,000. The petition provides for an increase in the project cost of 1% per month after November of 2010 due to cost increases over time resulting from inflation. All project costs, including the cost of financing, would be paid by the owners of the property through special assessments.

Legal Considerations: K.S.A. 19-27,181 et seq., as amended by Charter Resolution No. 62 of the County (the "Act") authorizes the Board of County Commissioners (the "Board") to provide for the making of, Improvements which confer a special benefit upon property within a definable area of the County and may levy and collect special assessments upon property in the area deemed by the Board to be benefited by such Improvement for special benefits conferred upon such property by any such Im...
