The agreement permits the Noxious Weed Department to treat the Noxious Weeds that are growing on KDOT right-of-way in Sedgwick County.

Financial Considerations: Cost: $0  Fund Center: 22001-207  GL Acct: 34510  This agreement is a significant revenue source for the Noxious Weeds Department and accounts for $25,000.00+- of non-tax revenue annually.

 

Legal Considerations: Approved as to form and signed by the County Counselor's Office. K.S.A. 2-1314 establishes the duty of the secretary of transportation and the boards of county commissioners to control the spread of, and to eradicate, all noxious weeds on lands owned or supervised by them.  Under K.S.A. 2-1319, the cost of controlling and eradicating noxious weeds on state highways is the responsibility of the state department of transportation. The board of county commissioners has the authority to enter into agreements with the department of transportation with respect to maintaining right of way under K.S.A. 68-169.
