SAFE ACT COMPLIANCE.

RECOMMENDED ACTION: Designate the County Election Commissioner's Office to provide assistance under the SAFE Act.

A provision of the SAFE Act amends KSA 65-2418(a)(3) to allow a person wishing to register to vote, but who does not possess any of the valid documents needed to prove his/her US citizenship, to obtain a free certified copy of his/her birth certificate from the Kansas Department of Health and Environment/Office of Vital Statistics.
New Section 15 of the SAFE act allows any such voter registration applicant to obtain assistance, free of charge, from a county government office in transmitting his/her application for a free birth certificate to KDHE. This section of the law requires the board of county commissioners in each county to designate a county office or department to provide assistance at no charge to any person applying for a birth certificate from the State Registrar of Vital Statistics for the purpose of registering to vote. Such county departments shall transmit the necessary forms to the State Registrar's office at no cost to the person applying for the birth certificate.
Financial Considerations: No additional budget authority is requested to serve this function.
